The owners of Linh's Bakery are facing the first lawsuit after a food poisoning outbreak.
Linh's Bakery in Henrico County remains closed after the salmonella outbreak that the health department says left 250 customers ill last month.
A Fluvanna family including a 3-year old boy and an 88-year old man are now the first to sue the restaurant, complaining of severe stomach pain, diarrhea, vomiting and fever. They're seeking one million dollars in damages.
An attorney for the bakery owner says he anticipated claims, but is surprised this one was filed so quickly.
No word yet on when the health department will allow Linh's to reopen.
