ASHEVILLE — A Florida woman who says she was sickened in a recent salmonella outbreak here is suing a local tempeh maker and its supplier for at least $75,000.
Mary Ann Hurtado, a Jacksonville, Fla., nurse suffered “uncontrollable shaking, headache, vomiting, diarrhea” and missed months of work after eating the tainted food in March, according to a lawsuit filed Monday in U.S. District Court Western District in Asheville.
The lawsuit names tempeh maker Smiling Hara LLC, of Mars Hill, and Tempeh Online, of Rockville, Md., which supplied the culture to make the bean product.
Hurtado may be one of at least six plaintiffs represented by Seattle law firm Marler Clark, firm attorney Drew Falkenstein said Tuesday. The firm has represented clients in high-profile food poisoning cases, including a listeria outbreak from cantaloupes last summer and a 2006 E. coli outbreak traced to spinach.
