# Marler Clark Files Lawsuit on Behalf of Colorado Woman Sickened in Multistate Salmonella Outbreak Linked to Little Wicomico River Oysters sold at Whole Foods and Other Retailers and Restaurants

As of October 30, 2026, 28 people have been reported ill in 13 states: Pennsylvania (8), New York (4), Virginia (3), Colorado (2), Indiana (2), Maryland (2), and one each in Connecticut, Florida, Illinois, Iowa, Kentucky, Michigan, and New Jersey.

CDC, FDA, and state health officials are investigating a multistate Salmonella outbreak linked to raw oysters from the Little Wicomico Oyster Company, harvested from the Little Wicomico River area in Virginia. Five people have been hospitalized, and no deaths have been reported. CDC notes that the actual number of illnesses is likely much higher, since many people recover without medical care or testing.

On October 9, the company voluntarily recalled whole (shellstock) oysters harvested between September 18 and October 8, 2026, and Virginia temporarily closed the harvest area as a precaution. The recalled oysters should now be past their shelf life, but anyone with frozen oyster meat should check whether it’s part of the recall and throw it away or return it if so.

Salmonella usually causes diarrhea, fever, and stomach cramps starting 6 hours to 6 days after exposure, and most people recover within 4 to 7 days without treatment. Young children, older adults, and people with weakened immune systems are at higher risk of severe illness.

Marler Clark represents victims in this outbreak and has filed suit in federal court in Colorado against Whole Foods and Little Wicomico Oyster Company on behalf of a Colorado woman who got Salmonella after eating raw oysters bought at Whole Foods in Superior.
