# Evergreen Fresh Sprouts Broccoli Sprouts Salmonella Outbreak Lawsuits

 

 

 Marler Clark is investigating this outbreak. No lawsuits have been filed in it yet. The firm sued Evergreen Fresh Sprouts, LLC on behalf of four people sickened in the company’s 2014 outbreak and has represented victims of sprout outbreaks across the country for more than twenty years.

**Twenty-two people in four states are sick, and the sprouts were recalled on September 4**

[FDA](https://www.fda.gov/food/outbreaks-foodborne-illness/outbreak-investigation-salmonella-sprouts-september-2026) and [CDC](https://www.cdc.gov/salmonella/outbreaks/broccoli-sprouts-09-26/index.html) posted outbreak pages on September 9 confirming twenty-two illnesses in four states, two hospitalizations and no deaths, with onsets from July 7 to August 26, 2026. Of the nineteen people interviewed, all nineteen reported eating sprouts and seventeen reported broccoli sprouts specifically. Patients range in age from two to eighty-seven.

The outbreak was found by state health departments. On September 2 the [Washington State Department of Health](https://doh.wa.gov/you-and-your-family/illness-and-disease-z/foodborne-illness/outbreaks/2026-salmonella-outbreak-linked-broccoli-sprouts-evergreen-fresh-sprouts-llc) linked thirteen *Salmonella* Bovismorbificans illnesses in seven Washington counties — King, Whatcom, Spokane, Skagit, Snohomish, Walla Walla and Yakima — to broccoli sprouts from Evergreen Fresh Sprouts. Montana’s health department [said on September 3](https://montanaindependent.substack.com/p/2026-salmonella-outbreak-linked-to) that its patients bought the sprouts at Montana grocery stores and that it expected its count to rise once laboratory testing finished. It did. Washington now stands at sixteen and Montana at four.

On September 4, Evergreen Fresh Sprouts initiated a recall after a broccoli sprout sample collected and analyzed by Montana state officials tested positive for *Salmonella*. CDC has described that sample: Montana investigators collected an unopened package of broccoli sprouts from a sick person’s home, and whole genome sequencing showed it carried the outbreak strain. In Whatcom County, health officials told the [Cascadia Daily News](https://www.cascadiadaily.com/2026/sep/03/salmonella-outbreak-tied-to-broccoli-sprouts-sickens-3-whatcom-county-residents/) they did not have a confirmed list of every place the sprouts were sold or served.

**Nineteen of the twenty-two illnesses began in August**

Two people became ill on July 7 and one on July 14. There were then no reported onsets at all until August 2, after which cases run nearly daily through August 26. Nineteen of the twenty-two illnesses — eighty-six percent — began in August. The last onsets on the curve are also the least complete: it ordinarily takes three to four weeks to determine that a newly reported illness belongs to an outbreak, so more late-August and September cases are likely to be added.

[In 2011, CDC linked 25 *Salmonella* Enteritidis illnesses](https://archive.cdc.gov/www_cdc_gov/salmonella/2011/alfalfa-spicy-sprouts-7-6-2011.html) in five states to alfalfa and spicy sprouts sold under the Evergreen Produce label. On June 27 FDA [warned consumers directly](https://www.foodpoisonjournal.com/foodborne-illness-outbreaks/fda-issues-rare-warning-to-public-to-not-eat-evergreen-produce-sprouts/) not to eat them, a step the agency generally takes only when a company will not recall. The co-owner told [The Produce News](https://theproducenews.com/evergreen-produce-says-no-fdas-request-recall-sprouts) she had refused FDA’s request because a recall would be admitting guilt. The company [recalled](https://www.foodpoisonjournal.com/food-recall/evergreen-fresh-sprouts-recalls-alfalfa-sprouts-and-spicy-sprouts-because-of-possible-salmonella-ris/) on July 1. That October, FDA sent a [warning letter](https://www.foodsafetynews.com/fda-cites-idaho-sprouts-grower-for-food-safety-lapses) describing pipes dripping onto uncovered sprouts and employees handling them without clean gloves or aprons, and concluded the sprouts were adulterated.

[In 2014, CDC counted 19 people infected with *E. coli* O121](https://archive.cdc.gov/www_cdc_gov/ecoli/2014/o121-05-14/index.html) in six states, most of whom ate raw clover sprouts in sandwiches at Jimmy John’s, Pita Pit and Daanen’s Deli locations in Washington and Idaho. Seven of the sixteen with information were hospitalized. FDA’s [Form 483](https://www.fda.gov/about-fda/oii-foia-electronic-reading-room/evergreen-fresh-sprouts) recorded condensate and irrigation water dripping from rusty valves, tennis rackets with scratches and frayed plastic used to scoop sprouts, and a corroded pitchfork used to move them. There was no recall in 2014, and the company kept producing clover sprouts from the same seed lot for weeks after the outbreak was announced.

Phyllis Entis of eFoodAlert [reviewed the company’s inspection history](https://efoodalert.com/2026/09/04/second-salmonella-outbreak-linked-to-sprouts/) during this outbreak. FDA has inspected Evergreen repeatedly since 2010. Most inspections after 2011, including the one conducted during the 2014 outbreak, were classified Voluntary Action Indicated. The most recent inspection was in 2024, also Voluntary Action Indicated, with no summary of observations posted to FDA’s inspection database.

**A product sample finally matched — and it came from a patient’s home, not the plant**

In both 2011 and 2014, epidemiology and traceback identified this grower while product samples came back negative for the outbreak strain. That is the ordinary shape of a sprout outbreak. The contaminated lot is eaten before anyone tests it, and contamination clusters in a batch rather than spreading evenly through it.

This outbreak is the exception, and how it happened matters. The positive sample was an unopened package of broccoli sprouts that a sick person still had at home, collected by Montana investigators and sequenced by a state laboratory. It is the first time in three Evergreen outbreaks that a product sample has matched. It is also a reminder of why a negative sample proves very little: had that consumer thrown the bag away, as almost everyone does, there would be no positive at all and the epidemiology would be exactly as strong.

**The recall covers product with September dates, not the sprouts that made people sick**

The recalled sprouts carry expiration dates of 9/7, 9/9, 9/11, 9/14 and 9/16. The illnesses began on July 7, and the most recent reported onset was August 26. Raw sprouts have a shelf life measured in days. Every package that caused an illness in this outbreak was consumed or discarded well before the recall was announced.

What the recall does provide is the identifying information consumers and retailers had been missing: a brand, a product, a package type and a set of dates. What it does not provide is a public account of how sprouts leaving this facility came to carry *Salmonella* in July, in August, and — on the evidence of a positive package bearing a September date — in September. On [distribution](https://www.cdc.gov/salmonella/outbreaks/broccoli-sprouts-09-26/locations.html), FDA has confirmed Idaho, Montana and Washington and says the product may have traveled further; Utah has a reported illness and is not on that list.

FDA has been able to order a recall since January 2011, six months before the first Evergreen outbreak. **What to do now if you bought or ate these sprouts**

● Do not eat broccoli sprouts from Evergreen Fresh Sprouts, including any package with an expiration date of 9/7, 9/9, 9/11, 9/14 or 9/16. Throw them away or return them, and wash anything they touched with hot soapy water or in a dishwasher.

● See a doctor for diarrhea with a fever above 102°F, diarrhea lasting more than three days, bloody diarrhea, vomiting that keeps you from holding down liquids, or signs of dehydration.

● Report your illness. Washington uses an [online Foodborne Illness Notification form](https://redcap.doh.wa.gov/surveys/?s=L7THW4XYPDE9NYNC); Whatcom County Health and Community Services is at 360-778-6000. Montana, Idaho and Utah residents should call their local health department.

● Keep the package or receipt, or a photo of either, and ask the laboratory or health department to preserve your isolate. Whole genome sequencing is what ties an individual illness to this outbreak, and isolates are routinely discarded.

**You may have a claim if these sprouts made you sick**

A company that sells a contaminated food is responsible for the harm it causes, whether or not a product sample tests positive. What matters is proof: a laboratory-confirmed infection, a genetic match to the outbreak strain, and evidence that you ate the product. Damages in these cases include medical bills, lost wages, the cost of care during recovery, and the lasting complications *Salmonella* can leave behind, including reactive arthritis and, in a small number of people, irritable bowel syndrome that does not resolve.

Limitation periods differ in Washington, Montana, Idaho and Utah, and a claim against a public entity can require formal notice within months rather than years. If you were sickened in this outbreak, do not wait to find out which deadline applies to you.

**There is a recall now. Does that change my case?**

It helps, but it was never required. A recall is a public health tool, not a legal prerequisite. Liability turns on whether the food you ate was contaminated and made you sick. What the recall adds is a documented set of dates and products to match against your purchase.

**What if my sprouts are gone?**

Most are, and that is expected with a product that lasts a few days. A receipt, a loyalty card record, a delivery order, or a photograph can establish the purchase, and the laboratory match to the outbreak strain does the rest.

**My illness started before the recall. Am I still part of this outbreak?**

Almost certainly, if your isolate matches. Every confirmed illness in this outbreak began between July 7 and August 26, weeks before the September 4 recall. The recall covers product still on shelves; it does not define who was hurt.

**I ate the sprouts at a restaurant. Does that change anything?**

It adds a defendant, not an obstacle. In 2014 the sick were eating sprouts on sandwiches at sandwich shops, and the claims ran to the grower and to the restaurants that served the product.
